When James was 17 he was visiting his neighbor John. They decided to practice rappelling out of a large tree in John’s yard. As James prepared to let go of the tree, John was distracted and released the rope. James fell over 25 feet and broke his back. Three years later James filed suit against John and his parents, claiming permanent disability and a neurological disorder as a result of the fall.

As the parameters of the audit expanded to family and known associates, evidence of a large family gathering was found that was date and time stamped over two years after the accident. On a social media page of a cousin, photographs of the subject participating in a splash competition in a pool were uncovered. These images included stills of the subject performing acrobatic moves. Additionally, a video was found of the subject playing softball with his extended family, hitting the ball, running the bases and sliding into home.
